Please read these Terms of Service ("Terms") carefully before using the Tiny Nest mobile application ("App") operated by Tiny Nest ("we", "our", or "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Description of Service
Tiny Nest is a baby care tracking application that helps parents and caregivers log and monitor their baby's feeding, sleep, diaper changes, health records, and developmental milestones. The App also provides AI-powered care suggestions and analytical reports.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use Tiny Nest. The App is designed for parents and caregivers, not for use by children.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Subscriptions and Payments
Tiny Nest offers both free and premium subscription plans:
- Free tier: Basic tracking features with limited history.
- Plus tier: Extended tracking, unlimited history, and reports.
- Premium tier: All features including AI-powered insights and advanced analytics.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscription in your Apple ID Account Settings.
- Any unused portion of a free trial period will be forfeited when you purchase a subscription.
- Refunds are handled by Apple in accordance with their refund policies. Please contact Apple Support for refund requests.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to the App's systems or other users' accounts.
- Reverse engineer, decompile, or disassemble any part of the App.
- Use the App to transmit harmful, offensive, or inappropriate content.
- Interfere with or disrupt the App's infrastructure or other users' experience.
- Use automated systems or bots to access the App.
6. AI-Powered Features
- AI responses are generated by third-party AI models and may not always be accurate or complete.
- We do not guarantee the accuracy, reliability, or suitability of any AI-generated content.
- Never delay seeking professional medical advice because of information provided by the App.
- In case of a medical emergency, contact your local emergency services immediately.
7. Intellectual Property
The App, including its design, features, content, and code, is owned by Tiny Nest and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. User Data and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.
9. Account Deletion
You may delete your account at any time through the App's settings. Upon deletion:
- All your personal data, baby profiles, and tracking history will be permanently removed from our servers.
- This action is irreversible.
- Active subscriptions must be cancelled separately through Apple's App Store settings.
10. Limitation of Liability
To the maximum extent permitted by law:
- Tiny Nest is provided "as is" without warranties of any kind, either express or implied.
- We do not warrant that the App will be uninterrupted, error-free, or secure.
- We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
- Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Tiny Nest and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
13. Termination
We may suspend or terminate your access to the App at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users or our business interests.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
